Terms of Service
Last updated:
These terms apply to your use of Pritrek ("the app"). By using the app you accept them. If you do not accept them, do not use the app.
1. What Pritrek is
Pritrek is a personal trip log. It records where you drive, detects stops, and keeps your vehicles and odometer readings, on your own device. Using it requires a Google account: you sign in with it before first use, and it can back up your data to your own Google Drive.
2. Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on your own devices for your own purposes. You may not copy, sell, rent or reverse engineer the app, except where the law allows it despite this restriction. The app includes open-source software that is licensed under its own terms; you can read them under Settings → Third-party notices.
3. Do not use the app while driving
Look at the road, not at the app. Set up and review your trips only when it is safe and legal to do so, and never operate the app while driving. You are responsible for obeying traffic laws.
4. Distances and times are estimates
Positions come from your device's location sensors and can be inaccurate or missing, for example in tunnels, in bad weather, or when battery saving limits background work. Distances, odometer values, stop detection and trip times are estimates. Do not rely on them as evidence for tax, insurance, legal, employment or reimbursement purposes without checking them yourself.
5. Your data and backups
Your data is yours. It stays on your device, kept separately for each Google account that signs in, and, if you connect Google Drive, in backups in your own Google Drive. You are responsible for keeping it safe: uninstalling the app or clearing its storage deletes the data on the device, and a lost or reset phone loses it unless you have a backup. You are responsible for your Google account. If you set a backup password and forget it, the backups encrypted with it cannot be restored by anyone, including us. How your data is handled is described in the Privacy Policy.
6. Third-party services
The app uses Google Maps to show the map, your device's map service to find place names, Google sign-in to identify your account and, if you connect it, Google Drive for backups. These services are provided by others and have their own terms and privacy policies, which apply when you use those features. By using the map you also agree to be bound by the Google Maps/Google Earth Additional Terms of Service (https://www.google.com/help/terms_maps/) and the Google Privacy Policy (https://policies.google.com/privacy).
7. Availability and changes
We may change, suspend or stop the app or any feature of it. We do not promise that the app will run without interruption or errors, or that recording will work on every device: the maker of your phone may stop background apps.
8. No warranty
To the extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, lost profits or lost data, or for anything that results from relying on the app's estimates, and our total liability for any claim is limited to the amount you paid for the app. Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence, or removes rights you have as a consumer under mandatory law.
10. Ending your use
You can stop using the app at any time by uninstalling it. We may end your licence if you break these terms. Sections 4, 8 and 9 continue after that.
11. Governing law
These terms are governed by the law of the country where the developer is established, as shown on Pritrek's Google Play page, without removing the mandatory consumer protection that applies to you where you live.
12. Changes to these terms and contact
We may change these terms; the date at the top shows when. If you keep using the app after a change you accept the new terms, and where the law requires it we ask you again. Questions about these terms: pritrek@thymoria.net. These terms are published in English only. The app itself is shown in your language, so the names of its screens and buttons quoted here, such as Settings → Third-party notices, may read differently on your device.
